Attempt by PAM to delay Appeal hearing thwarted, Attorney General’s Chambers facilitates photocopying documents for Shawn Richards

BASSETERRE, ST. KITTS (CUOPM) – An attempt by the People’s Action Movement (PAM) to delay Tuesday’s hearing of the Contempt of Court Appeal involving the Federation’s Attorney General was thwarted in the Court of Appeal Tuesday morning.
Moments after Senior Counsel Mr. Anthony Astaphan, S.C., lead attorney for the team representing the Attorney General, Dr. the Hon. Dennis Merchant, informed the three-judge panel that he was ready to proceed, Mr. Leslie Haynes, Counsel for the Hon. Shawn Richards, PAM’s sole representative in the 15-member St. Kitts and Nevis National Assembly, told the Court that his record was “incomplete” and he needed approximately 36 hours in order to photocopy documents that his side needed to submit to the Court in the hearing.
Court of Appeal Justice, the Hon. Michael Gordon asked whether QC Haynes couldn't have the copies done within a 15-minute to 2-hour time frame considering the resources available to him.
Haynes failed to explain good reason why the copies could not be made within a shorter period of time.
Senior Counsel Astaphan was quick to offer assistance in order to prevent any attempt to delay the Court and offered the resources of the Attorney General's Chambers in making the copies immediately.
Haynes stressed that transcripts were missing and claimed that the record before the Court was not complete and stated that the Court should not proceed without the record being complete.
SC Astaphan quickly revealed that the transcripts spoken of by QC Haynes were totally irrelevant to his side’s argument.
The Court suggested it had no intention to adjourn in order to wait for the copies to be made.
QC Haynes accepted the offer and the matter finally began 90 minutes after the Court commenced.
Both sides made presentations to the Court of Appeal led by Her Ladyship, Madame Justice Ola Mae Edwards, His Lordship Mr. Justice Michael Gordon and His Lordship, Mr. Justice Davidson Baptiste. The Court has reserved its judgement.
